Galapagos Seaways is part of Galapagos a la Carte (Galacarte S.A.). The following terms apply to all reservations, bookings, amendments, and cancellations for Galapagos Seaways only.

Galapagos a la Carte (hereinafter called the "Company") is an online tour agency that offers activities, tours, trips, accommodation and other services (collectively, the "Services") and in packages/bundles (the "Services packages") in The Galapagos Islands and Ecuador operated by Galapagos a la Carte Galacarte S.A. with VAT number/R.U.C. 2091761222001, a company headquartered in The Galapagos Islands in Ecuador. You (the "Client"), a person with over 18 years old, with the capabilities (physical and economical) to travel, make a reservation/booking and pay for our Services.

By clicking any submitting button ("Send", "Book", "Book Now", "Confirm", "Pay and Confirm", "Pay Balance", etc.) you signify your assent to these Terms of Use. In case of disagreement, please close this website and DO NOT click on it.

 

1. Information Accuracy: The Company strives to provide accurate and updated information on all service descriptions. However, we are not liable for any errors, omissions, or misinterpretations that may occur despite these efforts.

2. Commitment of Good Faith: The Company commits to acting in good faith, aiming to deliver a safe, enjoyable experience that meets the Client's expectations.

3. Reservations/Bookings: Bookings can be made via:

A reservation becomes binding once full payment is made and a written confirmation (Voucher or Ticket) is issued.

4. Payment Methods: Accepted methods: Credit Card via Payyo and Trekksoft Software as our booking system integrated in our website. No payment method incurs a fee. Methods are subject to change.

5. Price , Fares & Tariff Changes: Prices are in USD and may vary due to provider costs, fuel, taxes, demand, or government levies. Once fully paid, your price is locked and will not be altered.

6. Cancellation Policy:
Cancellation policies vary by Fare Type:

  • Economy Fare: 100% penalty, no refund.
  • Flexi Fare: 50% penalty (minus fees), up to 48 hours before departure.
  • Plus Fare: 0% penalty, up to 24 hours before departure.

Cancellations must be submitted in writing and will be effective once received and replied by The Company. No refunds for no-shows or failure to present valid travel documents.

7. Amendment/Modification Policy:
Amendments must be submitted in writing and will be effective once received and replied by The Company:

  • Economy Fare:
    • Date change: $15.00 + fare difference, up to 72 hours before departure.
    • Route change: Not allowed.
  • Flexi Fare:
    • Date change: $10.00 + fare difference, up to 48 hours before departure.
    • Route change: Not allowed.
  • Plus Fare:
    • Date change: Free, no fare difference, up to 24 hours before departure.
    • Route change: $10.00 + fare difference, up to 24 hours before departure.

8. Modifications by the Company: In the case of uncontrollable events (e.g. storms, pandemics, policy changes), Galapagos Seaways reserves the right to alter or cancel any travel arrangements. This may be decided by headquarters or on-site staff. No compensation or refunds are granted in such cases.

9. Client Responsibilities: Clients must:

  • Follow Ecuadorian Law and Galapagos National Park rules.
  • Cooperate with staff and guides.
  • Act respectfully and environmentally consciously.

10. Insurance: It is highly recommended that Clients obtain international travel insurance covering medical emergencies, trip changes, lost items, and repatriation.

11. Risk Assumption & Liability Release: Participation involves inherent risks (e.g., hiking, marine wildlife, sea conditions). By booking, the Client assumes all risks and agrees to release Galapagos Seaways and its representatives from any loss goods, injuries. Clients also agree to indemnify the Company against any resulting loss or claims.

12. Health Disclosure: Clients confirm they are in good health and capable of participating in the Services. Hidden health issues that prevent full participation are the sole responsibility of the Client and do not warrant a refund.

13. Limitation of Responsibility: The Company adheres to Ecuadorian Laws regarding the limitation of liability.

14. Disputes & Claims: Disputes will be resolved under Ecuadorian Law. Claims must be submitted within 30 days of the service date. Liability is limited to the amount actually paid by the Client. No compensation will be made for consequential or intangible damage.
